DMCA Policy
Last updated: March 5, 2025
Domain ("we," "us," or "our") respects the intellectual property rights of others and expects users of our platform at domain.biz to do the same. This Digital Millennium Copyright Act Policy ("DMCA Policy") outlines how we respond to claims of copyright infringement and how affected parties may submit or counter a notice of infringement.
1. Reporting Copyright Infringement
If you believe that content available through our platform infringes upon a copyright you own or control, you may submit a written notice of infringement to our designated agent. To be effective under the DMCA, your notice must include all of the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work or works claimed to have been infringed.
- Identification of the material that is claimed to be infringing, with sufficient detail to allow us to locate it on our platform (such as a URL or specific description).
- Your contact information, including your full name, mailing address, telephone number, and email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
2. Designated Copyright Agent
Notices of claimed copyright infringement should be sent to our designated agent at the following contact information:
- Company: Domain
- Address: 393 Rue Acadie, Grande-Anse, NB E8N 1E2, Canada
- Email: [email protected]
- Phone: +1 604 876 9911
We recommend sending notices by email to ensure prompt receipt. Notices submitted by other means may experience delays in processing.
3. Our Response to Infringement Notices
Upon receipt of a valid and complete infringement notice, we will act expeditiously to:
- Review the notice for completeness and compliance with DMCA requirements.
- Remove or disable access to the allegedly infringing material.
- Notify the user who posted or uploaded the material that it has been removed or disabled.
- Document the notice for our records.
We reserve the right to decline to act on notices that are incomplete, inaccurate, or that we determine in our sole discretion do not constitute valid claims of infringement.
4. Counter-Notification Procedure
If you believe that material you posted was removed or disabled as a result of a mistake or misidentification, you may submit a written counter-notification to our designated agent. A valid counter-notification must include:
- Your physical or electronic signature.
- Identification of the material that has been removed or disabled and the location at which it appeared before removal or disablement.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification.
- Your full name, mailing address, and telephone number.
- A statement that you consent to the jurisdiction of an appropriate judicial forum for any action arising from the counter-notification.
Upon receipt of a valid counter-notification, we may restore the removed material within 10 to 14 business days unless we receive notice that the original complainant has filed a legal action seeking a court order against the content provider.
5. Repeat Infringer Policy
We maintain a policy of terminating accounts of users who are found to be repeat infringers. A user may be deemed a repeat infringer if they receive multiple valid infringement notices relating to content they have uploaded or posted through our platform. We will take appropriate action, up to and including permanent account termination, in accordance with this policy.
6. Misrepresentation
Under the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability. We strongly encourage you to consult a legal professional before submitting a notice or counter-notification if you are uncertain whether the content in question constitutes infringement.
7. Third-Party Content
Our platform may contain or provide access to content uploaded, shared, or otherwise provided by third parties. We do not pre-screen user-generated content and are not responsible for content uploaded by users. However, we are committed to addressing valid copyright claims in accordance with this policy and applicable law.
8. Modifications to This Policy
We reserve the right to update or modify this DMCA Policy at any time. Changes will be posted on this page with a revised effective date. Continued use of our platform following the posting of changes constitutes acceptance of those changes.
